Since the South Dakota v. Wayfair, Inc. decision, nearly every state has adopted sales tax economic nexus changes. However, Florida has not yet made any such changes. The Sunshine State has no remote sales tax law and does not have income tax. Some lawmakers proposed legislation that would require remote businesses with sales in Florida to collect and remit sales tax, but the most recent measure was indefinitely postponed and withdrawn from consideration on March 14, 2020. That proposed law was SB126, but it died in appropriations. Currently, there are no Florida economic nexus changes.

Summary: Even though Florida does not currently have sales tax nexus rules, it does not necessarily mean that it never will. Physical and remote businesses that operate within the state should keep an eye out for any potential Florida sales tax economic nexus changes.
