The upper house of the German Federal Parliament (Bundesrat) recently weighed in on the Growth Opportunities Act, which includes provisions related to mandatory e-invoicing, during its session on October 20.
Currently, in Germany, issuing an electronic invoice requires the buyer’s consent. However, the new act aims to introduce mandatory e-invoicing for domestic B2B transactions with a phased implementation schedule. According to the current plan, all taxpayers will be required to accept e-invoices starting from January 1, 2025, and the mandatory issuance of e-invoices will begin on January 1, 2026, for large taxpayers.
Although the Bundesrat is in favor of the introduction of mandatory e-invoicing, it has put forward a proposal for a 2-year delay, suggesting that the mandatory receipt of electronic invoices should commence on January 1, 2027.
