The Georgia Department of Revenue recently published an updated version of the Employer’s Tax Guide. This publication provides information for employers including how to file and pay withholding tax returns, withholding tax tables, and annual filing of information returns.
The Guide remains largely unchanged from its previous version with the exception of the addition of penalty information as it relates to filing of annual information returns including Forms W-2 and 1099. The penalties are as follows:
- $10 per statement filed up to 30 calendar days after the date such statement is due, provided that the total amount imposed on a person pursuant to this paragraph shall not exceed $50,000.00.
- $20 per statement filed at least 31 calendar days, but not more than 210 calendar days after the date such statement is due, provided that the total amount imposed on a person pursuant to this paragraph shall not exceed $100,000.00.
- $50 per statement filed 211 calendar days or more after such statement is due, provided that the total amount imposed on a person pursuant to this paragraph shall not exceed $200,000.00.
Please note that these penalties are not new but were newly added to this publication. For a statutory reference, please see Ga. Code Ann. §48-5-106(c).
