Colorado Requires EITC/CITC Notice for All Employees Beginning in 2023

Beginning with tax year 2023, Colorado law requires employers to provide all employees with an annual notice of Earned Income Tax Credits and Child Income Tax Credits. This week, the Colorado Department of Revenue released criteria that employers must follow when providing the EITC/ CITC notice to employees.

Notice may be printed or sent electronically. If providing printed notice of the EITC / CITC, employers must provide the notice on its own page. The notice must be at least 5.5 x 8.5 inches. The notice does not need to be in color. If providing electronic notice of the EITC / CITC, employers may provide the notice by email or text message.

There is no specific form required to be provided. Employers can use the second page of DR 0995 in its entirety or incorporate the exact language from the second page of DR 0995 into a separate document. The employer should provide the notice in English and in any other language the employer uses to communicate with the employee to whom the notice is sent.
